1. Agreement to Terms
By accessing and purchasing from the OrigaMode website ("the Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("User," "Customer," "you") and OrigaMode ("we," "us," "our"). If you do not agree with any part of these terms, you must not use or make purchases from this Site.
2. Products and Orders
OrigaMode sells a variety of apparel including, but not limited to, Dresses, Tops, T-Shirts, Skirts, Coats, Hoodies, Sweaters, Jackets, Sets, Onesies, and Belts. All products are subject to availability. We reserve the right to limit quantities, discontinue products, and correct errors in pricing or product information without prior notice. Your order constitutes an offer to purchase, which we accept by sending an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccuracies, or inventory issues.
3. Intellectual Property Protection
All content on this Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and the overall "look and feel," is the property of OrigaMode or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. The OrigaMode name and logo, and all related product and service names, are proprietary trademarks. You may not use any meta tags or any other "hidden text" utilizing our name or trademarks without our express written consent. Any unauthorized use terminates the permission or license granted by OrigaMode.
4. Limitation of Liability
To the fullest extent permitted by applicable law, OrigaMode shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
Our total cumulative liability to you for all claims arising from or related to the Site and your purchases shall not exceed the greater of one hundred US dollars (USD $100) or the amount you have paid to OrigaMode in the last six (6) months for the specific product giving rise to the claim.
5. Refund & Return Policy
We want you to be completely satisfied with your purchase. If you are not satisfied, you may return eligible items within 30 days of delivery for a refund or exchange, provided the items are unworn, unwashed, undamaged, and in their original packaging with all tags attached. Final sale items, personalized goods, and undergarments are not eligible for return unless defective.
To initiate a return, please contact our customer service team at [email protected] with your order number. You will be responsible for the cost of return shipping unless the return is due to our error (e.g., wrong or defective item). Refunds will be issued to the original payment method once the return is received and inspected. Please allow 5-10 business days for the refund to process after we receive your return. Shipping charges are non-refundable.
6. Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
